Terms of Service

The Platform is the software Weather Ops LLC provides to manage roofing projects, exchange documents and messages with customers and subcontractors, schedule work, track storm-damage claims, and operate roofing businesses. The Platform is provided to:

• Customers (property owners) — to receive proposals, sign documents, view project status, and communicate with our staff
• Subcontractors — to receive work orders, exchange job documents, and coordinate with our staff
• The operating contractor's staff — to do their jobs
• Other roofing contractors and businesses — under separate written subscription agreements (B2B customers)

You must be at least 18 years old and have legal authority to enter into these Terms. If using the Platform on behalf of a business, you represent you have authority to bind that business.

You agree to:

• Provide accurate, current, complete information
• Maintain the confidentiality of your login credentials
• Notify us promptly of unauthorized access or use
• Use the Platform only for lawful purposes

You are responsible for activity that occurs under your account.

You agree not to:

• Use the Platform to send unsolicited or non-consented messages (SMS, email, voice) to any person
• Treat generated leads, property records, skip-traced data, public records, weather events, or third-party contact data as consent to call, text, email, visit, or market to any person
• Use the Platform to harass, threaten, abuse, or defame any person
• Use property imagery, maps, aerial or satellite views, roof data, routing tools, or lead-generation features for stalking, surveillance, harassment, intimidation, doxxing, discrimination, scams, or any other abusive purpose
• Use the Platform to transmit content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable
• Upload, store, transmit, publish, or ask us to process documents, photos, logos, videos, maps, screenshots, or other content unless you own it or have all rights, licenses, consents, and permissions needed to use it in the Platform
• Misuse AI features to deceive, impersonate, defraud, harass, discriminate unlawfully, generate malicious code, bypass safety controls, create abusive content, or violate any law or third-party right
• Send content in violation of A2P 10DLC messaging policies, including SHAFT content (sex, hate, alcohol, firearms, tobacco) where prohibited
• Attempt to gain unauthorized access to the Platform, other accounts, or related infrastructure
• Probe, scan, test the vulnerability of, or breach security or authentication measures
• Use any automated means to access, scrape, or extract Platform content beyond authorized API access
• Scrape, cache, export, re-host, train models on, or create unauthorized derivative datasets from maps, aerial imagery, property data, lead data, or third-party content accessed through the Platform
• Reverse-engineer, decompile, or attempt to derive the source code of the Platform
• Interfere with or disrupt the Platform's integrity or performance
• Resell or redistribute Platform access without written authorization
• Violate any applicable law, including TCPA, CAN-SPAM, CCPA, and equivalent state laws

We reserve the right to suspend or terminate accounts that violate these provisions.

When you submit your phone number, email address, or other contact information through the Platform, you authorize us to communicate with you about your project, including by SMS, email, and phone. You consent specifically to receive SMS messages by checking the appropriate consent box; see our SMS Terms for the SMS-specific terms and frequency disclosures.

You may opt out of SMS messages at any time by replying STOP. You may opt out of marketing emails using the unsubscribe link in any marketing email. Transactional messages (signature requests, appointment confirmations, project status updates) will continue while your project is active because they are necessary to perform the services you requested.

The Platform may be used to request inspections, receive estimates, and execute project agreements. Use of the Platform does not by itself create a contract for services. A binding contract for roofing services exists only when a separate written service agreement is signed by both parties. The signed service agreement controls scope, pricing, materials, warranties, timelines, and payment terms and takes precedence over conflicting Platform information.

Estimates generated or transmitted through the Platform are based on visible conditions and information you provide. Estimates may change upon discovery of hidden damage. Written estimates are valid only for the periods stated on them. Verbal estimates are non-binding.

The contracting business you work with may assist with documentation and communication related to insurance claims. Such businesses are not licensed public insurance adjusters and do not negotiate claims with carriers. No decisions about coverage or payment are made through the Platform — those are made by your insurance carrier. You remain responsible for understanding your policy, deductible, and carrier obligations.

If you are invited to the Platform as a subcontractor, you agree to:

• Use the Platform only to perform work assigned to you by the contracting business that invited you
• Maintain the confidentiality of customer information
• Not contact that business's customers outside the Platform except as directed
• Comply with the same Acceptable Use restrictions in Section 3
• Follow project-specific instructions from that business's staff

Subcontractor access is governed by these Terms plus any separate subcontractor agreement. The separate agreement controls when conflicting.

WeatherOps and WeatherHailOps may provide lead-generation, property-intelligence, weather, hail, map, aerial imagery, routing, roof, permit, and related tools. These tools are powerful business tools and must be used only for lawful, legitimate roofing and contracting workflows.

A lead record, public-record match, property-owner record, skip-traced contact record, storm-hit indicator, weather event, or map result is not consent to contact that person by SMS, autodialed call, prerecorded call, marketing email, door-to-door visit, or any other regulated outreach method. You are solely responsible for TCPA, CAN-SPAM, Telemarketing Sales Rule, Do Not Call, state privacy, state mini-TCPA, local solicitation, and similar compliance before contacting any lead or property owner.

We may suspend, restrict, or terminate access immediately if we believe these tools are being used for harassment, surveillance, discriminatory targeting, scams, unauthorized scraping, unlawful outreach, or any other misuse.

You are responsible for every document, photo, image, logo, video, message, map screenshot, customer file, insurance document, and other item you upload, import, generate, store, send, or ask the Platform to process. You represent that you own that content or have all rights, licenses, permissions, releases, and consents necessary for Weather Ops LLC and its subprocessors to host, store, display, transmit, analyze, synchronize, transform, and otherwise process it to provide the Platform.

You may not upload or process copyrighted, confidential, proprietary, private, or regulated content unless you have the right to do so. We may remove or disable access to content, preserve evidence, report suspected misuse, restrict features, suspend users, terminate accounts, or ban repeat infringers or bad-faith uploaders. Copyright or takedown notices may be sent to the contact information listed below.

The Platform is a business operations service, not private personal storage. To operate, secure, support, debug, improve, moderate, and enforce the Platform, authorized Weather Ops LLC personnel and service providers may log and review account activity, uploaded files, images, documents, messages, AI prompts and outputs, integration metadata, support context, diagnostic events, and suspected misuse.

You should not use the Platform for content or activity you are not authorized to share with your business, Weather Ops LLC, or the service providers needed to operate the Platform.

You retain ownership of the content you submit (photos, documents, signatures, messages, project details). You grant Weather Ops LLC a non-exclusive, worldwide, royalty-free license to host, store, transmit, and process your content as necessary to provide the Platform and the services you have requested.

Weather Ops LLC retains ownership of the Platform itself, including software, design, brand, and all intellectual property. You receive no license to the underlying technology beyond what is necessary to use the Platform as intended.

The Platform integrates with third-party services (Gmail, Google Calendar, Slack, Twilio, smrtPhone, EagleView, CompanyCam, and others). When you connect a third-party service, you authorize Weather Ops LLC to access and process data from that service through our OAuth broker as described in our Privacy Policy.

Your use of any third-party service is governed by that service's terms. We are not responsible for the availability, accuracy, or content of third-party services. If a third-party service becomes unavailable, related Platform features may be reduced or disabled.

Google Maps, aerial imagery, property data, weather data, roof-measurement data, and other third-party content may be subject to additional provider terms, attribution requirements, access restrictions, retention limits, and privacy obligations. You agree to comply with those restrictions and not misuse, scrape, cache, re-host, or repurpose third-party content outside the Platform's authorized workflows.

We may make AI-assisted and experimental features available on the Platform. These are provided "as is" without warranty. AI outputs may be incomplete, inaccurate, unsafe for a specific use, or unsuitable without human review. You are responsible for reviewing outputs before using them in estimates, outreach, contracts, insurance documentation, customer communications, or operational decisions.

We may modify, remove, restrict, monitor, or disable AI and experimental features at any time, including where needed to reduce legal, security, safety, intellectual-property, or abuse risk.

THE PLATFORM AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WEATHER OPS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Platform information does not constitute professional, legal, or insurance advice and should not substitute for professional inspection or consultation. Weather Ops LLC does not warrant uninterrupted Platform availability and may suspend access for maintenance or operational reasons.

TO THE FULLEST EXTENT PERMITTED BY LAW, WEATHER OPS LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, SUBPROCESSORS, AND AFFILIATES ARE NOT LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from Platform use or inability to use the Platform
• Damages from delays, weather, supply chain issues, third-party service outages, or other circumstances beyond our reasonable control

Total liability for Platform-related claims shall not exceed the greater of (a) the total fees you paid Weather Ops LLC for the Platform in the twelve (12) months before the event giving rise to the claim, or (b) USD $100. Liability for contracted roofing work is governed by the signed service agreement, not these Terms. These limits do not apply where excluded by applicable law.

You agree to indemnify, defend, and hold harmless Weather Ops LLC, its officers, employees, contractors, subprocessors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of applicable laws (including TCPA and CAN-SPAM)
• Your violation of third-party rights
• Content you submit to or transmit through the Platform
• Your lead-generation, outreach, uploaded-content, AI, mapping, property-data, or third-party-service use

These Terms are governed by Nebraska law without regard to conflict of law principles. Disputes are resolved exclusively in state or federal courts in Douglas County, Nebraska, and you consent to personal jurisdiction there.

We may suspend or terminate Platform access at any time for violations of these Terms or for any reason on reasonable notice. We may suspend, terminate, or ban users immediately for suspected unlawful outreach, malicious use, copyright or content abuse, property-imagery misuse, AI misuse, security abuse, or repeated violations. Upon termination, your right to use the Platform ends. Sections that by their nature should survive (intellectual property, indemnification, limitation of liability, governing law) survive termination.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

We may update these Terms from time to time. We will post revised Terms with an updated "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the revised Terms. For material changes, we will provide additional notice where required by law.
